Subject: Invitation to Comment on Discussion Paper DIS-12-05, Administrative Monetary Penalties
The CNSC has released for public consultation discussion paper DIS-12-05, Administrative Monetary Penalties. Discussion papers are used to solicit comments from the public, licensees and interested organizations early in the regulatory process.
This discussion paper presents the CNSC’s proposed approach for the implementation of the administrative monetary penalties (AMP) system.
Bill C-38, the Jobs, Growth and Long-term Prosperity Act, which received Royal Assent on June 29, 2012, included amendments to the Nuclear Safety and Control Act providing the CNSC with the authority to establish an AMP system. Implementation of this system requires that the CNSC makes regulations that establish:
- what acts of non-compliance constitute a violation
- how the penalty amounts will be calculated
- how the required documents will be served to the penalized parties
The administrative monetary penalties system will constitute an additional enforcement tool to ensure compliance with nuclear regulatory requirements. To implement the system, the regulations will establish what acts of non-compliance will be designated as violations, how the penalties will be calculated, and how the relevant documents will be served.
The CNSC is seeking comments on the proposals contained in this discussion paper.
